The statute of limitations for bringing personal injury, product liability, and wrongful death actions varies state to state. In Maryland:
- Personal injury actions must be filed within three years from the date of the injury or date injury was or should have been discovered.
- Medical malpractice cases in Maryland must be filed within five years of the incident or three years of discovery of the injury, whichever is less. For minors under age 11, the statute of limitations begins to run on the minor's 11th birthday. Some exceptions apply.
